Public Liability Claims in NSW are governed by the Civil Liability Act 2002 (NSW). This legislation was introduced in 2002 in response to a campaign driven in part by the Insurance Industry arguing that the cost of Public Liability Insurance was being driven up by Public Liability Claims. This legislation has the effect of making it more difficult to succeed in some Public Liability Claims, particularly against Local Councils.
